Which Type Of Bankruptcy Should I File?

Most individuals who file for bankruptcy file either Chapter 7 or Chapter 13 bankruptcy. There are many differences between the two chapters.

Chapter 7 is essentially a liquidation process, in which your existing assets (aside from some exempt property) are used to pay off as much of your debt as possible. After this, the remainder of your debt is discharged. This is a relatively quick process and can be finished in just a few months.

Chapter 13 is a longer process that allows you to restructure your debt in a way that allows you to pay it off over time and protects you from creditor harassment in the meantime. This process generally takes between three and five years. During this time, you will be making monthly payments, but you can keep your property.
